Interim orders, stemming from a copyright dispute with Saregama, now prohibit him from commercially using or licensing songs from approximately 130 films, impacting a vast legacy.

Maestro’s Copyright Battle Stumbles

Prominent music director Ilaiyaraaja has suffered a major setback in the Delhi High Court concerning a copyright dispute, following the issuance of interim orders against him in a case filed by Saregama. This sensational ruling prohibits Ilaiyaraaja from commercially using or licensing songs from approximately 130 films to other platforms.

While Ilaiyaraaja had previously taken legal action against several individuals for using his music without his permission, this particular case was brought by the prominent music label ‘Saregama.’ Saregama’s argument states that in the past, film producers had permanently assigned the rights (copyright) of their film songs to Saregama as per agreements. The label approached the court contending that Ilaiyaraaja is now claiming rights over these very songs and licensing them to platforms like Amazon Music, iTunes, and JioSaavn, causing them significant financial losses. The court opined that, as per the 1957 Copyright Act, unless otherwise specified in an agreement, the producer generally holds the primary rights.
